1. Introduction

ExecuteWithYou LLC ("Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us through the ExecuteWithYou platform ("Platform"). This Privacy Policy explains what information we collect, how we use and share it, and the choices you have regarding your data.

By using the Platform, you consent to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.

2. Information We Collect

2.1 Personal Information

When you register for an account or use the Platform, we may collect: name, email address, phone number, mailing address, date of birth, government-issued identification numbers, and profile photographs.

2.2 Business Information

For merchants and clients, we collect: business name, entity type, Employer Identification Number (EIN), business address, industry, years in operation, and annual revenue.

2.3 Financial Information

To facilitate funding and commission payments, we collect: bank account details, credit information obtained through soft-pull credit checks, income verification documents, Stripe payment tokens, and transaction histories.

2.4 Usage & Technical Data

We automatically collect: IP address, browser type and version, device information, operating system, pages visited, time spent on pages, referral URLs, and clickstream data.

2.5 Communication Data

We retain records of closing calls (audio/video recordings stored in encrypted AWS S3, accessed via time-limited signed URLs), support tickets, chat messages, and email correspondence sent through the Platform. Income verification documents are stored in private Supabase Storage buckets (not publicly accessible).

3. How We Use Your Information

We use the information we collect to:

  • Create, maintain, and secure your account
  • Facilitate the merchant training program and track completion progress
  • Process funding applications, generate pre-qualified offers, and connect clients with funding sources
  • Verify document authenticity using AI-powered scanning (Gemini AI)
  • Process commission invoices and manage payment disbursements
  • Manage the CRM pipeline (contract sent, signed, onboarded)
  • Send transactional emails, onboarding instructions, and referral links
  • Grade AI-simulated sales calls as part of merchant training
  • Improve, personalize, and optimize the Platform
  • Comply with legal obligations and enforce our Terms
  • Detect, prevent, and address fraud or security issues

4. Third-Party Services

We integrate with the following third-party services to operate the Platform. Each service has its own privacy policy governing the data it processes:

Clerk — Authentication

Manages user registration, login, and session management. Processes email addresses, passwords (hashed), and authentication tokens. Clerk Privacy Policy

Stripe — Payment Processing

Handles subscription billing, commission invoice payments, and merchant payouts. Processes payment card details, bank account information, and transaction data. Stripe Privacy Policy

Supabase — Data Storage

Provides the PostgreSQL database and file storage infrastructure for all Platform data, including client records, documents, and closing call recordings. Supabase Privacy Policy

In-app electronic signatures

Contracts are signed inside ExecuteWithYou with a drawn signature, printed name, IP address, and user-agent retained for the audit trail. We do not use a third-party e-signature vendor for funding agreements.

Google Gemini AI — Document Verification

Scans uploaded income-proof documents to verify authenticity. Document images are transmitted securely and are not retained by the AI service beyond the processing window.

5. Data Security

We implement industry-standard security measures to protect your data, including: encryption in transit (TLS 1.2+) and at rest (AES-256), role-based access controls, regular security audits, secure API authentication, and infrastructure monitoring.

Despite our efforts, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but will notify affected users promptly in the event of a data breach as required by applicable law.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. Specific retention periods include:

  • Account data: retained for the duration of account activity plus 3 years after deletion request
  • Financial records: retained for 7 years to comply with tax and regulatory obligations
  • Closing call recordings: retained for 5 years from the date of upload
  • Usage logs: retained for 12 months

After the applicable retention period, data is securely deleted or anonymized.

California Residents

If you are a California resident, you may have additional rights under the CCPA/CPRA, including the right to know, delete, and correct personal information. California consumers may also have specific protections regarding call recording (two-party consent) and lending disclosures. Contact privacy@executewithyou.com for California-specific requests.

7. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Right to Access: Request a copy of the personal data we hold about you.
  • Right to Correction: Request correction of inaccurate or incomplete personal data.
  • Right to Deletion: Request deletion of your personal data, subject to legal and contractual retention requirements.
  • Right to Data Portability: Request your data in a structured, commonly used, machine-readable format.
  • Right to Object: Object to processing of your personal data for certain purposes, including direct marketing.

8. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to maintain your session, remember preferences, and analyze Platform usage. The types of cookies we use include:

  • Essential cookies: Required for authentication and core Platform functionality. Cannot be disabled.
  • Analytics cookies: Help us understand how users interact with the Platform so we can improve the experience.
  • Preference cookies: Remember your settings and display preferences.

You can manage cookie preferences through your browser settings. Disabling essential cookies may impair Platform functionality.

9. Children's Privacy

The Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected data from a person under 18, we will take steps to delete that information promptly.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will: (a) update the "Effective Date" at the top of this page; and (b) notify registered users via email or in-platform notification at least 15 days before the changes take effect.
